MedicBank Acceptable Use Policy

MedicBank is committed to maintaining a safe, professional, and respectful environment for all users of our platform, including healthcare professionals, staffing agencies, healthcare facilities, and public reviewers. This Acceptable Use Policy ("AUP") describes rules and guidelines for user behavior and content on MedicBank. All users must comply with this AUP, including those browsing without an account and registered users. By accessing or using MedicBank in any capacity, you agree to be bound by this AUP. Acceptance of this AUP is incorporated into our Terms of Use and by agreeing to be bound by our Terms of Use, you agree to be bound by this AUP.
By using MedicBank, you agree that you will not engage in any of the prohibited activities described below. These rules apply to all content you contribute (profile information, messages, job postings, reviews, etc.) and all interactions or technical actions on the platform.
Unless otherwise defined in this AUP, all capitalised terms used herein shall have the meanings set forth in our Terms of Use.
Illegal or Harmful Use

No Violation of Law: You must not use MedicBank to violate any
applicable local, national, or international laws or regulations. This includes laws relating to employment, data protection, intellectual property, and any other applicable regulations. For example, do not use the platform to facilitate any arrangement that would violate labor laws, or to post content that would be illegal (such as offering services that require a license you don't have, etc.).

No Criminal Activity: You may not use our service to plan,
engage in, or promote any criminal or fraudulent activity. This includes activities like human trafficking, illicit drug distribution, fraud schemes, or theft of personal data.

No Harm to Minors: You must not exploit or harm minors in any
way through our platform. Users must be at least 16 years old to create an account. Where you are user between the ages of 16 and 17, you acknowledge that we may require written consent from your parent or guardian to use our services.

Online Safety Compliance: MedicBank operates in accordance with
the applicable online safety laws and associated regulations. We endeavor to maintain our systems in order to:

assess and mitigate risks of harm to users;
-
proactively identify and remove illegal content;
-
implement age verification and parental controls where required;
-
report serious criminal offences to relevant authorities as
mandated by law; and
-
maintain transparent reporting on content moderation activities.

User Content Standards
We expect all user-generated content to be lawful, truthful, and respectful. We reserve the right to moderate all user content and content may be reviewed before publication or removed after publication without prior notice. Specific rules:

No Inappropriate or Offensive Content: Do not upload, share, or
publish any content that is obscene, pornographic, or sexually explicit. Content that depicts graphic violence or is excessively gory is prohibited. Similarly, do not post content that is excessively profane or vulgar.

No Hate or Harassment: You must not use MedicBank to transmit or
promote any content that is hateful, discriminatory, or harassing towards individuals or groups. This includes content that attacks or demeans someone on the basis of race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, or any other characteristic that is protected by law. We have zero tolerance for hate speech or abusive behavior.

No Defamation or False Information: Do not post false or
misleading information about another person or entity. This especially applies to reviews -- while honest negative feedback is allowed, deliberate falsehoods or unfounded accusations that could harm someone's reputation (defamation) are prohibited. Stick to factual, firsthand experiences and clearly label opinions as such. If you're unsure, avoid making potentially libelous statements.

No Personal Data of Others: Do not share personal information
about other people (especially patients or colleagues) without their consent. For example, reviews must not include personal data about staff or patients beyond perhaps a first name. Do not post anyone's full name, contact details, health information, or other private details. This is to protect privacy and comply with privacy laws. Medical information that can identify an individual or sensitive personal data should never be disclosed in user content. If describing a scenario, anonymise details.

No Sensitive Data Uploads: As a general rule, do not upload any
content containing sensitive personal data unless absolutely necessary for the service. Sensitive personal data includes things like social security numbers, financial account passwords, or medical records of individuals. For instance, candidates should not upload actual patient records as part of a profile, and facilities should not share resident information in job posts or reviews. MedicBank is not a platform for patient data exchange.

Accurate Profile and Listings: All information in your MedicBank
profile, job posts, or agency/facility listings must be truthful and accurate to the best of your knowledge. Do not misrepresent your identity, qualifications, affiliations, or the nature of job opportunities. Impersonation of any person or entity (including pretending to be a different healthcare provider or a representative of a facility you don't work for) is strictly prohibited. Candidates should not claim certifications they lack; Facilities should not advertise roles or conditions inaccurately. Corporate users (facilities and agencies) may be subject to verification processes before account activation and we may request documentation to verify identity, location, credentials, or business registration. If you provide us with false verification documents, this constitutes a serious violation subject to immediate termination.

Review Guidelines: When leaving a review:

Only review facilities where you have been a patient, resident,
family member of a patient/resident, or an employee/contractor. You must not post reviews on behalf of someone else or fabricate experiences.

Be respectful and constructive. It's acceptable to describe
problems (e.g. "the care was often slow"), but do not resort to personal insults or slurs ("the nurse was an idiot" is not acceptable).

No Conflicts of Interest: You may not review your own
facility or employer, and you should not review a direct competitor to maliciously impact their reputation. For example, a care home manager cannot pose as a patient's family to write a glowing review of their own home, nor a false negative review of a rival home.

We reserve the right to remove reviews that are proven to be
false, defamatory, or that otherwise violate these standards. Users can be banned for repeated abuse of the reviews system.

User Content License and Moderation: By posting content, you
grant us the rights to use it as described in our Terms. We do not pre-approve all content, but we may moderate and remove content that violates this AUP or any law. If you see inappropriate content, report it to us via the platform or at support@medicbankapp.com.
Prohibited Conduct and Uses
Beyond content guidelines, certain actions are not allowed on or via the MedicBank service:

Account Security and Sharing: You must maintain the
confidentiality of your account credentials. Account sharing is prohibited and each individual must create their own account. Where you are a corporate account, you may have sub-manager access, but each sub-manager must be individually authorized by the business. You must immediately notify us of any unauthorised use or access of your account. If you lose access to a corporate account due to employment termination, you must not continue using that account.

No Spam or Unsolicited Communications: Do not use the platform
to send spam. This includes unwanted mass messages, advertising unrelated services, phishing attempts, or repeated solicitations. For instance, Agencies should not spam candidates with generic offers, and users should not send mass messages promoting a product or non-MedicBank service. Any advertising or promotional content must be limited to areas explicitly designated (e.g., an Agency can describe its services on its profile, but cannot cold-message Facilities not connected to them with ads).

No Commercial Use Except as Intended: MedicBank is meant for
healthcare staffing and reviews. Using the user base or data for unauthorized commercial purposes is prohibited. This means you must not scrape user information to create marketing lists, you must not advertise third-party products to other users without permission, and you must not operate contests, lotteries, or pyramid schemes through our platform.

No Platform Circumvention: You must not intentionally circumvent
our platform's processes or fees. Systematic avoidance of platform fees may result in retroactive billing and other remedies as outlined in our Terms of Use. For example, Facilities and Agencies should conduct their hiring interactions through MedicBank as intended; deliberately moving off-platform to avoid paying a subscription or placement fee is against our terms. If you were introduced via MedicBank, honor our platform by continuing to use it for communications and transactions related to that relationship. Users found systematically avoiding the platform after using it to connect may face penalties or fees (as outlined in Terms of Use).

No Impersonation or Account Sharing: Use only your own account.
Do not impersonate others or falsely claim to represent an organization you do not. Agency or Facility staff should have their own sub-accounts rather than sharing one login among multiple people, for accountability. If you lose access to an official account (e.g., you leave a company), you must not continue using that account.

Cybersecurity Prohibitions:

No Unauthorized Access: Do not attempt to gain access to
systems or data you do not have permission to access. This means no hacking, pen-testing, or circumventing authentication or security measures. If you discover a security vulnerability, report it to us responsibly instead of exploiting it.

No Disruption: Do not interfere with the normal operation of
MedicBank. This includes not launching or propagating any viruses, malware, or other malicious code. Also, do not engage in denial-of-service attacks or other attempts to overload or crash the service.

No Automated Abuse: You may not use bots, scripts, or
automated methods to scrape data from our site without permission, or to create multiple accounts, or to excessively request information. The use of any robot, spider, crawler, or other automated means to access the service for any purpose, without our express permission, is prohibited. Search engines may index our site in accordance with our robots.txt, but other automated harvesting (especially of personal data) is forbidden.

No Framing or Phishing: You must not frame our website within
another site or create any derivative service that impersonates MedicBank. Also, do not use the MedicBank name, logo, or design to deceive others (like in phishing emails or fake websites).

No Reverse Engineering: Do not attempt to reverse engineer or
tamper with the platform's software, protocols, or code. Also, do not deploy any code or devices that attempt to probe, scan or test the vulnerability of any MedicBank system or network.

No Misuse of Platform Data: If you have access to data via
MedicBank (e.g., as a Facility viewing candidate profiles, or as an Agency handling candidate data), you must use that data only for the purposes it was provided (e.g., hiring decisions). You must not extract data to use outside of MedicBank in ways unrelated to the original purpose without consent. For instance, a Facility should not compile candidate emails from MedicBank to create an unrelated mailing list.

Privacy laws -- if you download or use personal data from
MedicBank, you must handle it securely and lawfully (see Terms of Use and Privacy Policy regarding independent controller responsibility). Any unauthorized selling or sharing of personal data obtained from MedicBank is strictly prohibited. Users who download or access personal data through MedicBank must delete such data when no longer needed for legitimate platform purposes, in accordance with applicable data protection laws.

No Interference with Others' Use: Do not engage in any activity
that disrupts or impedes other users' enjoyment of MedicBank. This includes:
-
Harassing or stalking others on the platform.
-
Spreading false rumors or organizing targeted attacks/bullying.
-
Repeatedly posting irrelevant content or unnecessarily negative
comments to deter others from using the service.
-
Attempting to influence or manipulate the platform's review or
rating systems unfairly (e.g., brigading reviews, using fake accounts to upvote/downvote content).
-
Intentionally completing a job or shift poorly or unsafely as a
form of sabotage is obviously outside the platform's scope, but to the extent any such malicious coordination were to occur via our service, it would be a violation.

Enforcement Actions
Proportionality Principle: All enforcement actions will be proportionate to the nature and severity of the violation, taking into account:

the seriousness of the breach;
-
whether it was intentional or inadvertent;
-
the user's previous compliance history;
-
potential harm to other users or the platform; and
-
availability of less restrictive remedies.
Progressive Enforcement: Where appropriate, we will apply graduated sanctions, escalating from warnings to more serious measures for repeat or severe violations. However, we reserve the right to impose immediate serious sanctions for violations that pose significant risk to users or legal compliance.
MedicBank reserves the right to enforce this Acceptable Use Policy in its sole discretion. Actions we may take for violations include, but are not limited to:

Content Removal: We may remove or modify any content that
violates this AUP or our Terms, without notice to you. This could include editing or redacting parts of a review that contain personal data or defamatory remarks, or deleting an inappropriate profile picture.

Warning Notices: For minor first-time offenses, we might send
you a warning outlining the violation and requiring corrective action. For example, if your profile contains prohibited wording, we may ask you to change it.

Account Suspension: We may temporarily suspend your account and
access to the service while investigating suspected violations or pending your remediation of an issue. During suspension, you will not be able to use your account, though we may allow you to log in just to download your data or communicate with us.

Account Termination: For serious or repeated violations, your
account will be terminated. Serious violations include things like fraud, harassment, significant privacy breaches, or illegal activity. Termination means you will be barred from using the service henceforth. We may also choose to ban your email, IP, or other identifiers to prevent
re-registration.

Re-registration Prevention: Following account termination for
serious violations, we may ban the associated email addresses, IP addresses, payment methods, or other identifiers to prevent you from re-registering for the services.

Fee or Benefit Forfeiture: If you violated the rules around
platform circumvention (e.g., avoided fees), we may charge applicable fees or, if already paid, not refund fees. If you earned some benefit through policy violation (like referral bonuses via fake accounts), we can revoke those.

Legal Action: In cases of unlawful conduct (e.g., data theft,
hacking, defamatory posts causing real harm, etc.), we may take legal action, including seeking injunctive relief or damages as appropriate. We will also cooperate with law enforcement requests and investigations.

Cost Reimbursement: If your violation causes us to incur costs
(for example, a malware you introduced causes damage, or we face legal claims due to your content), we may seek reimbursement from you for those costs, consistent with any indemnification obligations in our Terms of Use.

Reporting to Authorities or Others: We may report any activities
that we reasonably suspect violate law to appropriate law enforcement, regulators, or affected third parties. For instance, if a user is posting stolen private data, we might inform the data owner or authorities.
Enforcement Discretion: All enforcement actions are taken at our sole discretion considering factors including:

severity and nature of the violation;
-
user's history and intent;
-
potential harm to other users or the platform; and
-
applicable legal requirements.
We strive to be fair and consistent in enforcement. We will consider the context and severity of the violation. However, we are not obligated to provide prior notice or warnings -- accounts can be terminated without warning if the situation warrants it (e.g., clear egregious abuse).
If you believe we have taken action on your account or content in error, you may contact us to appeal the decision. Provide any relevant information for us to review. We will, at our discretion, reevaluate and either reinstate or uphold our action. Our decision on appeals is final.
Appeals Process: If you believe we have taken action on your account or content in error, you may appeal our decision by following this process:

Submitting an Appeal:

You must submit your appeal within 30 days of the enforcement
action being taken.

Appeals must be submitted in writing to
-
Your appeal must include:
-
your account details (username/email);
-
specific details of the enforcement action you are
appealing;
-
clear explanation of why you believe the action was taken in
error;
-
any supporting evidence or documentation; and
-
your preferred resolution.
-

Appeal Review Process:

We will acknowledge receipt of your appeal within 10 business
days.
-
We will conduct a thorough review of your appeal, which may
include:
-
re-examining the original violation and evidence;
-
reviewing relevant account history and context; and
-
considering any new evidence or information provided.
-

For standard appeals, we will provide our final decision within
20 business days of receipt and will notify you of any extension.
-

Appeal Outcomes:
-
We may:
-
uphold the original enforcement action;
-
modify the enforcement action (e.g., reduce suspension
period, restore content with edits); or
-
reverse the enforcement action entirely.
-
-
-
Our decision on an appeal is final and binding.
-
We will provide written notification to you of our decision and our
reason for coming to such a decision.
-
If an appeal is successful, we will implement the remedy promptly.
-
If an appeal is unsuccessful, further appeals will not be accepted
on the same matter.
Reporting Violations
All users are encouraged to report behavior or content that they believe violates this AUP or our Terms. If you encounter something or someone problematic:
-
Use the in-platform reporting function if available (for example, a
"Report" button on a review or message).
-
Or email us at support@medicbankapp.com with details. Please
include as much info as possible: usernames involved, what happened, when, and any evidence like screenshots or message IDs.
We will review reports confidentially. Your identity will be kept confidential to the extent practicable (we generally won't tell another user who reported them, unless required legally). However, we might reach out to you for follow-up information. Abuse of the reporting process (like false reporting to harass someone) is itself a violation and may result in account restrictions or termination.
Remember that not all unpleasant interactions are AUP violations. For example, a mildly negative review is not against the rules if it's genuine and not abusive. We reserve the right to not act on reports that we determine are not actually violations or are outside of our scope.
Guidance for Specific User Roles
Candidates/Freelancers: Ensure your profile is honest and that your communications with potential employers remain professional. Maintain complete accuracy in all profile information, including qualifications, certifications, experience, and availability. Upload only genuine credentials you currently hold and update your profile immediately when qualifications expire or change. Do not disparage past employers overly harshly, and don't share confidential details about previous workplaces. When on assignment through MedicBank, treat it as you would any job: follow the facility's rules, protect patient privacy, and report issues appropriately (to the facility or agency, not via a public forum). Maintain only one personal account, keep login credentials secure, and do not create multiple accounts or share account access with others.
Agencies: You must operate ethically on MedicBank with full transparency regarding fees, terms, and conditions. Present candidates you have the right to represent. Do not poach candidates or clients in a way that breaches agreements or that involves misrepresentation on MedicBank. Respect facilities' rules (e.g., if a facility says no phone calls outside the platform, abide by that). Keep communications on MedicBank as much as possible for transparency and record-keeping. Do not circumvent platform processes to avoid fees or use candidate information for unrelated marketing purposes.
Facilities/Employers: Use MedicBank for legitimate hiring needs. Don't post "bait" jobs that don't really exist just to hoard candidates or collect data without genuine hiring intent. Provide accurate job details including complete job descriptions with duties, qualifications, compensation, and working conditions. Treat candidates and agency reps courteously in communications and provide timely responses to applications and inquiries. After hiring via MedicBank, don't pressure staff to leave the platform or otherwise circumvent future usage. Provide accurate facility information including licensing and registration details, submit to verification processes as required, and use candidate data obtained through MedicBank only for legitimate hiring purposes. Do not extract candidate information for unrelated business purposes.
Public Reviewers: Write your reviews thoughtfully. They should be your own experiences based on genuine, personal experience as a patient, resident, family member, or authorised representative. Only review facilities where you have direct experience and do not post reviews on behalf of others or create multiple accounts for multiple reviews. If you have a serious unresolved issue (like malpractice or mistreatment) consider also pursuing official channels; MedicBank reviews aren't a substitute for reporting to regulators or law enforcement if needed. Refrain from naming individual staff in a negative way; if you must, maybe use role titles rather than names (e.g., "the weekend nurse"). Complimenting by first name ("Nurse Alice was wonderful") is generally okay, but avoid last names for privacy. Never include personal health information of yourself or others in reviews, and avoid sharing details that could identify other patients or residents. Accept that facilities have the right to respond to your reviews -- keep any dialogue civil. Focus on factual observations about care quality and service delivery using respectful language, and understand that MedicBank reviews are for community information, not formal complaint resolution.
Additional Terms
This Acceptable Use Policy may be updated from time to time, similar to our other policies. We will notify users of significant changes. It is your responsibility to periodically review these rules. Continued use of MedicBank signifies agreement to these guidelines.

In the event of any conflict or inconsistency between this AUP and our Terms of Use, the Terms of Use shall prevail and take precedence.
